Tshepo Macdonald Motswene (36), was released on bail by the Witbank Magistrates’ court on Tuesday, 14 November 2023, after he was arrested by the Hawks` Nelspruit based Serious Commercial Crime Investigation team for contravention of South African Revenue Services Act.
It is alleged that on 22 January 2020, Motswene who was a sole director of the company called TMM Material Supplier and Projects, registered for Income Tax and was allocated tax reference number by SARS. Accused was not registered for Pay As You Earn PAYE. He had a business account with First National Bank. He then submitted an Income Tax return for the year 2012 to SARS to claim PAYE credits that resulted in refunds.
The accused used false information and PAYE numbers not belonging to him on the claim for PAYE credits. The PAYE number used was that of the South African Police Services. The accused used false information on IRP5 certificate on the claim. As a result SARS suffered actual prejudice in the amount of R996 253.68.
The accused was release on R5 000-00 bail and the case was postponed to 6 December 2023 in the Middelburg Specialised Commercial Crimes court. Investigation is continuing.
