Kimberley Specialised Commercial Crime Court convicted and sentenced David Schalk Opperman on Thursday, 23 November 2023 to four (4) years direct imprisonment for fraud and money laundering. Between June and July 2020, Opperman and McKenzie (as agents) entered into a contract with the complainant to sell his agricultural chemicals on behalf of Lowveld/Laeveld Agrochem based in Hartswater.
The complainant received a stock report through his email and noticed that the accused gave him false reports indicating that certain stock items were still at Hartswater’s warehouse whereas they were already sold. Clients made payments into bank account belonging to Harts Crop Protection CC of which is contrary to their contract. According to the contract agreement, clients were supposed to deposit funds into Lowveld/Laeveld Agrochem bank account.
The company suffered an actual loss exceeding R2 million. On Monday, 06 November 2023, Harts Crop Protection CC was found guilty of fraud and sentenced to pay a fine of R50 000-00.
The matter against Theodorus McKenzie was withdrawn.
