Daniel Themba Mabunda (50), appeared before the Whiteriver Magistrates’ Court on Tuesday 12 December 2023, after he was arrested by the Hawks Nelspruit based Serious Commercial Crime Investigation for fraud and theft of trust money.
It is alleged that, during November 2021, the accused whilst practicing as an attorney, under practice name Mabunda (D&M) Inc Attorneys, received money from Road Accident Fund on behalf of his two clients. He did not pay over the full benefit to the clients. Instead, he used the money for his own benefit without the clients’ knowledge and consent. The accused submitted the first claim to RAF on behalf of his client. The claim paid out an amount of R858 968.00, and he only gave the beneficiary R486 146.22. The remaining money, which exceeded the maximum 20% an attorney, may legally deduct from each claim he kept for himself. On the second claim submitted to RAF, an amount of R468 366.29 was paid, and the actual beneficiary never received anything of the payment.
The accused was released on R5 000.00 bail by the Whiteriver Magistrates’ Court on Tuesday, 12 December 2023. The matter was postponed to 23 January 2024 for further investigation.
