The Khayelitsha Regional Court have on 09 February 2024 sentenced Denzil October (43) to an effective sixty (60) years imprisonment for murder of police official.
The sentence was imposed in terms of Section 105 A of the Criminal Procedure Act, Act 51 of 1977 and he was sentenced as follows:
On count one, which is robbery, the accused was sentenced to eight (8) years imprisonment.
On count two, which is murder, the accused was sentenced to thirty (30) years imprisonment.
On count three, which is attempted murder, the accused was sentenced to five (5) years imprisonment.
On count four, which is unlawful possession of a firearm, the accused was sentenced to fifteen (15) years imprisonment.
On count five, which is unlawful possession of ammunition, the accused was sentenced to two (2) years imprisonment.
The court further ordered that the sentences imposed in respect of counts one, three, four and five shall run concurrently with the sentence imposed in respect of count two.
The accused will therefore serve an effective term of thirty (30) years direct imprisonment.
In terms of Section 103 (1) and (2) of the Firearms Control Act, Act 60 of 2000, the accused was declared unfit to possess a firearm.
This sentence emanates from 2022 where an on duty police Constable was shot and killed in Grassy Park.
The multidisciplinary team comprising of the Hawks’ National Priority Violent Crime Investigation, Priority Crime Specialised Investigation, Grassy Park Vispol and Detectives, Crime Intelligence, Anti-Gang Unit and other Law Enforcement was established to probe the matter. October was identified, arrested and ultimately sentenced.
The Hawks Provincial Head in the Western Cape Major General Mathipa Makgato applauded the efforts made by the multidisciplinary team in the execution of the arrest and the National Prosecuting Authority in ensuring that justice is served.
