President Cyril Ramaphosa has signed the National Nuclear Regulator Amendment Bill into law, marking a significant step in enhancing nuclear safety and aligning South Africa with global regulatory standards.
This amended legislation updates the National Nuclear Regulator Act of 1999 to meet the International Atomic Energy Agency’s (IAEA) best practices, reflecting South Africa’s commitment as a founding member of the IAEA and a signatory to international nuclear safety conventions.
The revised law expands the scope and authority of the National Nuclear Regulator.
Among its key functions, it now oversees the decontamination, decommissioning, and repurposing of South African National Defence Force (SANDF) facilities, equipment, and materials for civilian use.
This measure ensures that such properties meet rigorous safety standards, safeguarding the public from radiation risks.
Additionally, the law empowers the Regulator to monitor and regulate occupational exposure to cosmic radiation for aircrew operating at altitudes below 49,000 feet, addressing a previously overlooked aspect of aviation safety.
To streamline governance, the Amendment Bill introduces new definitions, updates outdated terminology, and removes obsolete provisions.
It also refines the management of the Regulator’s operations, including stipulating board member terms and establishing specialised board committees.
These changes aim to enhance the efficiency and accountability of the Regulator while broadening its oversight capabilities.
The legislation also addresses a unique challenge related to naval vessels. It excludes the application of the Defence Act of 2002 concerning permits and inspections for foreign state naval vessels visiting South African ports.
This adjustment acknowledges the difficulties associated with foreign forces disclosing sensitive information about their vessels to host nations.
The amended law strengthens South Africa’s position as a responsible player in global nuclear governance by aligning its nuclear safety framework with international norms.
It enhances public and occupational safety and strengthens the oversight of activities that could pose radiation risks.
President Ramaphosa’s assent to this bill underscores the government’s commitment to upholding the highest standards of nuclear regulation and safety for the benefit of all citizens.
