    The National Energy Regulator of South Africa (Nersa) has consented to the transfer of Eskom’s powers and duties related to section 34 Power Purchase Agreements with Independent Power Producers (IPP) to the National Transmission Company South Africa (NTCSA).

    It also sanctioned issuing a cost recovery letter to the NTSCA for section 34 IPP projects to designate the NTSCA as the buyer in terms of the Energy Regulation Act.

    The regulator said Eskom’s application for consent to transfer its power and duties — submitted in December 2023 — was a pivotal step of the power utility’s unbundling process.

    The project aims to make Eskom more manageable and encourage more private sector participation in electricity production. It could also allow IPPs to compete directly with Eskom’s generation division.

    “The transition of the Buyer role for section 34 IPPs from Eskom to the NTCSA is a critical component of this process,” said Nersa.

    “The Reasons for Decision document will be available in due course.”

    Eskom hit another significant milestone relating to the unbundling process in January 2024 when it announced the appointment of the board of directors of the NTCSA.

    The Eskom board appointed twelve non-executive directors to the NTCSA’s board:

    • Priscillah Mabelane (Chairperson) — Executive vice president: Energy Business at Sasol.

    • Dr Brian Armstrong (Lead Independent Director) — Chair of Digital Business at Wits Business School and former group chief operating officer and group chief commercial officer at Telkom.

    • Prof Mark Swilling — Co-director of the Centre for Sustainability Transitions at Stellenbosch University and former Development Bank of South Africa chairperson.

    • Anu Sing — Non-executive director at i-Engineering Group and former MTN Group executive.

    • Lungile Mashele — Energy and infrastructure specialist at the Public Investment Corporation and former energy economist and energy specialist at Eskom.

    • Carmen Le Grange — Owner of Lincoln Advisory and former chief financial officer at Denel.

    • Nkosinathi Soloman — Energy expert with an MBA (Cum Laude) in Chemical Engineering.

    • Auke Lont — An internationally recognised expert in the transmission system operator environment and former chief executive officer at Norway’s Statnett.

    • Prof Francis Petersen — Rector and vice chancellor at the University of the Free State and former executive head of strategy at Anglo American Platinum.

    • Sedzani Mudau — Executive director of Favest Advisory, Chairperson of the board of Sentech, and a non-executive director of Ellies Holdings.

    • Dr Busisiwe Vilakazi —  Head of Research and innovation at the State Information Technology Agency and former senior researcher at the Council for Scientific and Industrial Research.

    • Tryphosa Romano — Non-executive director of the Eskom Holdings board of directors and qualified Chartered Accountant.

    The NTCSA secured a transmission licence from Nersa in July 2023.

    “The Transmission licence decision marks a significant milestone in the legal separation process of the Transmission Division,” said Eskom.

    It also applied for trading and import/export licences, which the regulator issued in September 2023.

    “The granting of the requisite operating licences to NTCSA is one of the key dependencies required to enable the operationalisation of the NTCSA,” said Eskom.
