A father and his two sons were sentenced to life in prison on Wednesday for the murder of a man they believed robbed them.
Given de Koker, 60, his sons Neillon, 30, and Clyde, 24, were sentenced in Kimberley Regional Court for the murder of Teboho Madiehe, 36.
According to a statement from the National Prosecuting Authority (NPA), the brothers were attacked by a group of men while walking home from a local nightclub on 1 December 2019. They were robbed of their cell phones and shoes.
They informed their father of the incident and together they decided to go in search of the robbers themselves. They encountered a man on the side of the road who saw them as one of the robbers. They assaulted the man by kicking him, stabbing him with a knife and beating him with a golf club, according to NPA Northern Cape spokesperson Mojalefa Senokoatsane.
The incident was reported to local police soon after, said police spokesman Sergeant Merapelo Pilane. The three assaulted the person until he lost consciousness, left him right there in the street and left the scene without any of the things they claimed he stole were found.
The state brought this fact to the court’s attention, arguing that Madiehe’s right to life and dignity had been violated, according to Senokoatsane.
There were no reasons put forward for criminal mitigation and the three men were convicted and they were sentenced to life in prison. The defendants were also declared incompetent to possess a firearm.
Detective Sergeant Modise Clive Moshotloa was commended by the management of the police in the Northern Cape for his dedication and painstaking detective work that led to a breakthrough.
The police also issued a dire warning to the community not to take law into their own hands.
